ESOLCENTRE.UK LTD TERMS AND CONDITIONS OF SERVICE
ROLE AND RESPONSIBILITIES
2. Service description:
2.1. To provide online support to ESOLCENTRE.UK‘s registered students via tutor messaging platform.
2.2. To plan and deliver online lessons (mainly speaking and listening) in accordance with the ESOL curriculum.
2.3. To mark tests and provide written feedback (optional)
2.4. Carry out assessments during the lessons and submit written feedback through the organisation’s system, typically on the same or the following day.
2.5. Keep up to date records of their group(s) of students.
2.6. Must not miss or be late for sessions. Tutors who do not attend a scheduled session will have their service agreement terminated immediately.
Must have a PC and reliable (fast) internet connection, with camera and headphones.
Flexible working hours vary from 9 am to 6 pm, Tuesday- Saturday. Additional working hours can be arranged.
3. Pay:
£10/hour. Fees are paid on the 15th of every month. All fees are subject to review.
All of the above require submission of a brief assessment, feedback (via Tutor Platform).
Marking includes: Check list, learning objectives (met, not met, partially met), specific feedback, areas for improvement
All fees are VAT inclusive.
4. Legal:
4.1.The freelancer must not at any point before, during and/or after the sessions, offer their services to students or company’s partners independently or in any other form unless this has been agreed with the ESOLCENTRE.UK LTD in writing.
4.2. The freelancer must not sub-contract any third parties for the delivery of this service agreement.
4.3. This service agreement shall terminate immediately in the event of failure of the freelancer to observe any of the responsibilities listed. Advance notice of minimum 48 hours is required in the event that a freelance tutor is unable to attend a scheduled lesson. If the freelancer fails to meet the advance notice requirement set in this clause, money accumulated for this last pay period will be reviewed and any expenses the company has incurred as a result will be deducted, also the freelancer may be billed for any remaining amounts.
4.4. The duration of this agreement is ongoing and can be terminated by either party with two weeks written notice.
4.5. Support materials/information and contacts: Courses descriptions and learning objectives, website https://www.esolcentre.uk, test marking templates, sample lesson plans, resources, assessment guide, advice and assistance where required, contacts list on the Tutor Platform.
4.6. The tutor consents some personal details such as name, qualifications and professional experience may be shared with students and partners, and occasionally be used in company’s promotional materials.
4.7. Any legal disputes will be resolved by the English court, if an informal settlement cannot be reached.
CONFIDENTIALITY
(1) The freelancer will conduct her/himself in a proper, skilful and professional manner at all times.
(2) The freelancer shall not agree any further work with a competitor client (to the organisation) for similar or related work without first receiving the agreement of the organisation, and shall not solicit further work from a competitor client directly for similar or related work.
(3) The freelancer will not (except in the proper course of their duties hereunder) use or divulge or communicate to any person any confidential information which belongs to the organisation or any students or partners.
CONFLICT OF INTEREST
Definition: A conflict of interest may occur when the personal or business interests of an individual conflict with their professional duties and responsibilities. Such conflicts could result in damage to the integrity and reputation of the ESOLCENTRE deliver or compromise the validity of a learner assessment and the award.

COPYRIGHT
The entire copyright in all material written by the freelancer in the course of carrying out this work will be held by the organisation who shall have the exclusive right to publish any such material throughout the legal term of copyright.
Any learning/assessment materials provided by the organisation to the tutor must be kept confidential. The personal use, sharing, distribution and posting of these materials are strictly prohibited.
STATUS
(1) This agreement does not form the basis of an employment relationship between the organisation and the freelancer, and the freelancer is responsible for paying their own tax and National Insurance contributions.
(2) The freelancer is not an agent of the organisation and cannot create any obligations for it.
ALTERATION
This agreement can be changed only with the written consent of both sides.
FORCE MAJEURE
Neither party shall be deemed in default of its obligations under this agreement nor shall be liable to the other to the extent that it is unable to perform any of its obligations by reason of any event or circumstance beyond its reasonable control.

- Annual Review: (If you have worked for us 12+months and received positive student feedback you will be eligible for a fee increase in the first annual review) or a bonus.

CODE OF CONDUCT for tutors
- I understand that my role as a tutor is to encourage and enable learners to achieve their potential as independent learners through acknowledgement, encouragement, understanding and personalised attention.
- I will be careful to avoid creating any unhealthy dependencies by suggesting a need for tutoring where no such need exists; reporting in a manner that explicitly or implicitly suggests a need for further on-going tutoring or engaging in any practice that undermines the independent learning of students.
- I will not engage in any form of plagiarism, such as completing students’ assignments for them.
- I will provide honest, positive and constructive feedback to my students.
- I am committed to identifying any particular challenges or difficulties my students might have with their learning and to assisting them in overcoming those barriers.
- I will report any concerns I have about students’ social, emotional and behavioural difficulties that are beyond my competency to address.
- I will identify and report to the organisation any special educational needs that are beyond my experience or ability to resolve.
- I understand that my relationship to my students is professional and not personal and that I have a duty of care towards them.
- I will show respect for my students’ cultural background, personal dignity and values.
- I will maintain accurate records of tutoring sessions as required.
- I will not seek to provide educational services to students or company partners I have been introduced to by the company.
